Monster Mini Golf Mobile App – Terms of Service

Welcome to the Monster Mini Golf mobile app (“App”). This App is provided by Monster Entertainment LLC dba Monster Mini Golf (“Company,” “we,” “us,” or “our”) to enhance your mini golf experience. By downloading, accessing, or using the App, you agree to these Terms of Service (“Terms”).

1. Acceptance of Terms

By using the App, you agree to comply with these Terms. If you do not agree, please do not use the App.

2. Use of the App

  • The App is designed to track scores, enhance gameplay, and provide a fun experience at Monster Mini Golf locations.
  • You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian. We do not assume any legal responsibility for false statements about age.
  • You agree to use the App for personal, non-commercial purposes only.

3. User Accounts

  • Some features may require you to create an account. You are responsible for keeping your login details secure.
  • We may suspend or terminate your account if we detect misuse, fraud, or violation of these Terms.

4. Privacy

  • We collect and process personal data as described in our Privacy Policy.
  • We do not sell your data, and we use it only to improve the App experience or improve or enhance your visit at Monster Mini Golf.

5. SMS/TEXT MESSAGING TERMS (MOBILE MESSAGING)

If you opt in to receive SMS/text messages from Monster Mini Golf, we may send text messages related to promotions and special offers, event and reservation updates, customer service responses, and other information you request or consent to receive. Message frequency varies. Message and data rates may apply.  Opt out: You can opt out at any time by replying STOP to any message. You may receive a final confirmation message after you opt out. Help: For help, reply HELP or contact us at (704) 755-5722 or info@monsterminigolf.com.  Carriers are not responsible for delayed or undelivered messages.  You must be 18 or older to opt in to receive SMS/text messages. If you are under 18, you may not enroll in SMS/text messaging.  For more information about how we collect, use, and protect personal information, please review our Privacy Policy at: https://www.monsterminigolf.com/privacy-policy/   UPDATE THIS LINE IN SECTION 2 (USE OF THE APP):  Replace: “You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian.”  With: “You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian. You must be 18 or older to opt in to receive SMS/text messages.”

6. In-App Content & Intellectual Property

  • All content in the App is owned by Monster Mini Golf or licensed to us. This includes all images, text, logos, documents, downloadable files and anything that contributes to the composition of our App.
  • You may not copy, distribute, or modify the App’s content without our permission.

7. App Updates & Changes

  • We may update the App, add new features, or modify these Terms at any time. Continued use of the App after updates means you accept the changes.

8. Limitation of Liability & Indemnity

  • The App is provided “as is” without warranties of any kind. We are not responsible for errors, disruptions, or any damages related to App use.
  • We are not liable for any losses (including loss of score or inaccurate scorekeeping), damages, liabilities, expenses, and claims related to your use of our App.
  • Except where prohibited by law, by using this App you indemnify and hold harmless Monster Mini Golf and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our App or your violation of these Terms.

9. Termination

  • You may stop using the App at any time.
  • We may terminate or suspend access to the App if you violate these Terms.

10. Governing Law

  • These Terms are governed by the laws of North Carolina.

11. Severability

  • If at any time any of the provisions set forth in these Terms are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms. All other provisions will not be affected by the removal and the rest of these Terms and will still be considered valid.
